Engagement

Privacy and confidentiality are of paramount importance to Eidolon Therapeutic Counseling.  Successful engagements require an active measure of trust, respect, attentiveness and commitment with clients and sensitive material.

Confidentiality is the legal and ethical duty not to reveal information to unauthorized individuals.  ETC is bound by these legal, ethical, professional statutes and codes of conduct.  Clients have the legal and ethical right to prevent disclosure of information shared by them in counseling without their consent.

New York State law requires that confidentiality be maintained at all times, and that a client’s right to privacy and a client’s right to confidentiality in relation to communications shared in counseling are one and the same.  Clients complete a Confidential Disclosure Agreement, which confirms that session material will not be shared.

Privacy, confidentiality and HIPPA compliance rules will be further discussed at client consultation and initial intake.

Mandated Reporting

Mandated reporters are required to report suspected child abuse or maltreatment when they are presented with a reasonable cause to suspect child abuse or maltreatment in a situation where a child, parent, or other person legally responsible for the child is before the mandated reporter when the mandated reporter is acting in his or her official or professional capacity.  “Other person legally responsible” refers to a guardian, caretaker, or other person18 years of age or older who is responsible for the care of the child.

Mandated reporters who are social services workers have expanded reporting requirements. They are required to report when, in their official or professional role, they are presented with a reasonable cause to suspect child abuse or maltreatment where any person is before the mandated reporter and the mandated reporter is acting in his or her of ficial or professional capacity. Reasonable cause to suspect child abuse or maltreatment can be based on rational observations, professional training and experience, a suspicion that the parent or other person legally responsible for a child is responsible for harming that child or placing that child in imminent danger of harm.

New York State recognizes certain professionals as mandated reporters. For a printable listing go to: https://ocfs.ny.gov/publications/Pub1159/OCFS-Pub1159.pdf
